§ 14-400. Tattooing; body piercing prohibited.
(b) It shall be unlawful for any person to pierce any part of the body other than ears of another person under the age of 18 for the purpose of allowing the insertion of earrings, jewelry, or similar objects into the body, unless the prior consent of a custodial parent or guardian is obtained. Anyone violating the provisions of this section is guilty of a Class 2 misdemeanor. (1937, c. 112, ss. 1, 2; 1969, c. 1224, s. 8; 1971, c. 1231, s. 1; 1993, c. 539, s. 269; 1994, Ex. Sess., c. 24, s. 14(c); 1998-230, s. 9.)
This law specifies that it is unlawful for any individual to perform body piercings on another person who is under 18 years of age, with the exception of ear piercings. If a minor wishes to have a piercing in any area of the body other than their ears, the law mandates that they must obtain prior consent from a custodial parent or guardian. This includes piercings intended for jewelry or similar objects. The intent behind this regulation is to protect minors from undergoing procedures that could carry risks or complications without the informed approval of their guardians. If someone is found to be in violation of this law, they can face legal consequences, specifically being charged with a Class 2 misdemeanor, which is classified as a minor offense. In essence, the law emphasizes the importance of parental oversight and consent in matters related to body modifications for minors, ensuring that guardians have a say in decisions that could affect their child's health and well-being. Therefore, if a person under 18 is interested in getting a body piercing—other than for their ears—they must first secure permission from their parent or guardian.
